Terms of Service

These Terms govern your use of the ShakeGasm app on Android, iOS, and the web. By creating an account or otherwise using the app, you agree to these Terms.

1. Eligibility

You must be at least 13 years old (or the age required by your country to consent to online services, whichever is higher) to use ShakeGasm. By creating an account you represent and warrant that you meet this requirement.

2. Account

• You are responsible for keeping your account credentials secure.
• You may not share your account or transfer it to another person.
• One person, one account — automated mass-creation of accounts is prohibited.
• We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used abusively.

3. Purchases & refunds

• Voice packs and the Pro Bundle are one-time purchases that unlock access for the lifetime of your account.
• Purchases on Google Play are processed by Google; purchases on the App Store are processed by Apple. Refunds are handled per the relevant store's policy.
• If a purchase is refunded, the corresponding entitlement will be revoked.
• "Manual" or "promo" entitlements granted by us are not paid purchases and may be revoked at any time.

4. Acceptable use

You agree NOT to:

• Reverse-engineer, decompile, or attempt to extract source code from the app.
• Tamper with or attempt to bypass authentication, payment, entitlement, or anti-abuse systems.
• Use the app to harass, defame, or threaten other users or third parties.
• Upload or record audio that infringes someone else's rights or that depicts a minor.
• Use the app for any illegal purpose or in violation of applicable laws.

5. User content

If you record audio using the Custom Voice Studio, that content stays on your device. You retain ownership of your recordings. By using the Custom Voice feature you confirm that you have the right to record and use the audio you create.

6. Intellectual property

The app, voice packs (excluding your custom recordings), branding, and code are owned by ShakeGasm. You receive a non-exclusive, non-transferable license to use the app and the voice packs you have unlocked, for personal non-commercial use only.

7. Disclaimer of warranties

The app is provided "as is" and "as available". We do not warrant that the app will be error-free, uninterrupted, or that it will meet your expectations. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied.

8. Limitation of liability

To the maximum extent permitted by applicable law, our total liability for any claim arising out of or relating to the app is limited to the amount you have paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

9. Termination

You may stop using the app and delete your account at any time. We may terminate or suspend your access to the app if you violate these Terms or for any other reasonable cause. On termination, your right to use the app ceases; your data is handled per the Privacy Policy.

10. Changes

We may update these Terms from time to time. Material changes will be communicated in-app or via email. Your continued use after the effective date constitutes acceptance.
